👉 Watch the video below to hear Attorney Dan Mowrey explain what the personal injury claim process looks like, then keep reading for a step-by-step breakdown.

Step 1: The Initial Consultation

Every claim begins with a conversation. During your consultation, you’ll meet with one of our attorneys to review the details of your case. We’ll discuss the elements of your claim, assess its viability, and answer any initial questions you may have. Our goal at this stage is to make sure you understand your options and feel supported from the very beginning.

Step 2: Investigation and Building Your Case

Once we take on your claim, the investigation process begins. This includes:
– Reviewing liability (who is at fault).
– Evaluating the insurance coverages available.
– Identifying witnesses.
– Documenting your damages.

This stage ensures we have the evidence needed to build a strong foundation for your case.

Step 3: Medical Treatment and Recovery

As you continue your medical treatment, we track your progress and gather important medical records. This may involve chiropractors, neurologists, surgeons, or other specialists depending on your injuries. We work closely with your providers to document the extent of your injuries and how they impact your life.

Step 4: Demand and Negotiation

Once your doctors determine that you’ve reached maximum medical improvement meaning they’ve done all they can for your recovery, we move to the claim stage.

Here, we submit a formal claim in the form of a demand to the insurance company that outlines:
– Your medical expenses.
– The impact of your injuries.
– An amount necessary to settle your claim based on available coverage and extent of your damages.

From there, we negotiate aggressively on your behalf to secure the best possible settlement.

Step 5: Litigation (If Necessary)

While many claims are settled during the negotiation phase, not all do. If a fair agreement cannot be reached, our attorneys are fully prepared to file a lawsuit and represent you through litigation. From filing the complaint to trial, we stand by your side to fight for the compensation you deserve.
