Do Personal Injury Cases Go to Court?

One of the most common questions we hear from clients is, “Will my personal injury case go to court?” The short answer is usually no, but sometimes court is necessary to protect your rights and ensure fair compensation.

In this FAQ video, Attorney Daniel Mowrey of Mowrey Law Firm, based in St. Augustine, Florida, breaks down why some personal injury cases go to court so you can be prepared for every situation. Watch this short video now:

Most Personal Injury Cases Settle Outside of Court

For the majority of personal injury claims, going to court is not required. After we file a claim and present a demand to the at-fault party or their insurance company, most cases are resolved through a negotiated settlement. These settlements allow injured individuals to recover compensation without the stress, time, and uncertainty of a trial. However, not every case settles, and when that happens, court may be the best or only option.

When Going to Court Becomes Necessary

There are a few key reasons why a personal injury case may need to be decided in court:

1. The Insurance Company Won’t Pay Fair Value

Sometimes, the at-fault party or their insurance company refuses to offer a settlement that truly reflects the value of your injuries, damages, and losses. When a fair agreement can’t be reached, filing a lawsuit may be the only way to pursue the compensation you deserve.

2. There’s a Dispute Over What Happened

In some cases, the facts of the accident are contested. One party may claim the incident happened one way, while the other tells a completely different story. If the evidence doesn’t lead to a clear settlement, the case may need to be presented to a judge or jury to determine who is responsible.

3. Complex Legal Issues Are Involved

Florida personal injury law is constantly evolving. Some cases involve complicated questions about liability or damages that require a judge or jury to interpret the law and apply it to the facts of your case.
